Application Of Terms


Terms and conditions apply exclusively to every booking agreement with any client, and that all quotations are made and all orders are accepted on and subject to these terms & conditions. No terms introduced by the customer shall take priority over the terms & conditions of Pat Holt Films.

 

Booking & Payment


A non-refundable, non-transferable booking fee is payable ASAP to secure the date, this amount being the agreed loss suffered by the videographer due to cancellation or postponement. The balance is due prior to two weeks before the wedding date. 

In the event that more than one client wishes to book wedding services on the same day, preference will go to the first client to pay the booking fee. Rescheduled weddings will only be accommodated if the new date does not conflict with another booked wedding. 

 

Late Payment Fees


Failure to pay the stated balance before 2 weeks prior to the Wedding will result in a late fee charge of £50 which will be added to the remaining balance.

Failure to pay the stated balance and the £50 late fee after 1 week prior will result in a second added late fee charge of £50. The total amount owed now being the remaining balance stated plus £100 in total late fees.

Failure to pay the remaining balance stated and all late fees before 48 hours prior to the wedding date will result in a no-show by Pat Holt Films on your requested date. 

 

Contract Termination


In the event of accident or illness preventing Pat Holt Films from appearing on the day, the client shall be informed at the earliest opportunity and, if requested by the client, medical evidence will be provided. The client will not be obliged to pay a fee for any services Pat Holt Films is unable to provide.

 

Cancellations


The client reserves the right to cancel the booking agreement at any time, by doing so in writing to Pat Holt Films. Any initial booking fee paid is non-returnable and non-transferable as the services which this payment covers will have already been provided by Pat Holt Films at the point of cancellation. This includes holding the date from other potential clients, plus any and all admin and communications covered in the booking process up until and following the agreed wedding date. Cancellations made within the following timescale will also be liable for the following further cancellation charge:
60 Days or less - 50% of the Balance Due amount.
Cancellations must be made in writing or emailed to Pat Holt Films. For security reasons they will not be accepted over the phone.

 

Interference


Pat Holt Films will be the exclusive professional videographer service in attendance. Friends and family are permitted to operate video cameras on the condition that they do not interfere with or get in the way of the professional coverage.

 

Behaviour


The client is held fully responsible for their guest’s behaviour. Pat Holt Films will not tolerate abusive clients and/or guests, and will cease production in the event of threatening behavior. Pat Holt FIlms reserves the right to end all services early, without prior notice or refund, in the interests of personal safety.

 

Church Fees & Venue Access


It is the client's responsibility to secure access to areas for videography. Pat Holt Films will not be responsible for coverage lost due to access restrictions. This includes paying any Church fees to allow videography.

 

Arrival


Pat Holt Films can give no guarantee to attend the ceremony and/or venue at the time specified in the booking agreement due to circumstances that are out of the videographer’s control, e.g. adverse weather conditions, heavy traffic, road closure etc. Best attempts will always be made to deliver services at the time stated.

 

Equipment Operation


Only Pat Holt Films may operate his company equipment. Under no circumstances, may unauthorised personnel tamper with, move or attempt to use equipment owned by the videographer. Pat Holt Films cannot accept responsibility for damage caused to the event venue, or injury caused to the client, guests and/or venue staff caused directly by third party intervention.

 

Creative Aspects


Pat Holt Films has full creative control of the final product. Creative aspects such as shooting and editing style are at the discretion of Pat Holt Films. Any requests for changes to the films are chargeable and are at the discretion of Pat Holt Films.

 

Hospitality


Pat Holt Films will be provided a guest meal for weddings lasting longer than 5 hours. If no meal is provided Pat Holt Films may reserve the right to go off-site for a meal for 45 minutes. Bathroom breaks may be taken when necessary.

 

Force Majeure


The client agrees that Pat Holt Films shall not be liable for any and all losses, including damages, costs, claims, compensation, and other liabilities which arise as a result of any delay or interruption in, or any non-delivery, missed delivery or failure of the equipment and/or services due to circumstances beyond the control of Pat Holt Films or any of our suppliers’ and contractors’ reasonable control (including, but not limited to, fire, lightning, explosion, war, disorder, flood, industrial dispute, sabotage, weather conditions, road closure, vandalism, traffic congestion, vehicle failure or acts of local government or other competent authorities).

Pat Holt Films’ maximum liability arising out of or in connection with the non supply of services on the event date and at the venue location shall be limited to the total value of the booking agreement fee in pounds.

 

General


The booking agreement shall be governed by and constructed in accordance with the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales. In the event that the agreement is translated into any other language, the english language version shall prevail. You must not assign or subcontract any of your rights or obligations under these terms and conditions or any related order for products to any third party.

If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

 

Health and Safety


It is the responsibility of the client to ensure the venue complies with current Health & Safety Regulations, holds all necessary certification including Public Liability Insurance, Public Performance Licenses, and where acceptable, relevant PAT test certification. Pat Holt Films ensures that equipment fully complies with the relevant and current Health & Safety legislation regarding the equipment and company staff.

It is the responsibility of the client and/or venue to provide a safe & suitable area within the venue location to facilitate installation of equipment. Any floor surface, staging, mounting area or electricity supply which is deemed unsuitable or unsafe by Pat Holt Films may delay or prevent installation of equipment. If installation cannot be completed successfully the client cannot be provided with any services. In this event no refunds, in part or full, will be given for non-use of equipment that cannot be used due to any Health & Safety implications imposed on Pat Holt Films by the client and/or venue.

 

Archived Footage


Upon taking possession of the finished product, the client must inform Pat Holt Films of any technical problems with the video within 7 days. After 7 days, if no notification has been received, the client will be deemed to be satisfied with the product. Pat Holt Films does not maintain archives of projects after this time.

 

Promotion


The client will allow Pat Holt Films to display any imagery related to the event, for the purposes of advertising and promotion.

 

Prices and Quotations


All package prices are fully inclusive of delivery, labour, and insurance. Quotations are valid for 7 days.

 

Contract Agreement


By paying the booking fee the client is agreeing to all terms & conditions stated in
this contract.
